Copyright Policy
Effective date: The date this policy is first published at gukkit.com/copyright.
Gukkit respects intellectual property rights. This policy explains how to report claimed copyright infringement in the Gukkit service, how counter-notices work, and what happens to repeat infringers. It is part of our Terms of Service.
Designated DMCA agent
Under 17 U.S.C. 512, we have designated the following agent to receive notifications of claimed infringement:
- Name: Granary
- Address: 6881 W Charleston Blvd, Ste A, Las Vegas, NV 89117
- Email: granary.usa@gmail.com
Send all infringement notices and counter-notices to this agent. Reports sent anywhere else may not be processed.
Filing an infringement notice
If you believe content on Gukkit infringes your copyright, send our agent a written notice containing all of the following (17 U.S.C. 512(c)(3)(A)):
- Your physical or electronic signature (or that of someone authorized to act for the copyright owner).
- Identification of the copyrighted work claimed to be infringed, or a representative list if multiple works are involved.
- Identification of the material claimed to be infringing, with information reasonably sufficient for us to locate it (for example, a link, or a precise description including the posting account's anon number and the date posted, and the room or surface where it appeared).
- Your contact information: address, telephone number, and email address.
- A statement that you have a good-faith belief the disputed use is not authorized by the copyright owner, its agent, or the law.
- A statement that the information in the notice is accurate and, under penalty of perjury, that you are authorized to act on behalf of the copyright owner.
Notices missing these elements may be invalid, and we are not obligated to act on them. Before filing, consider whether the use might be lawful, for example under fair use: knowing material misrepresentation in a notice exposes you to liability under 17 U.S.C. 512(f).
What happens after a valid notice
On receiving a compliant notice, we will expeditiously remove or disable access to the claimed material, take reasonable steps to notify the user who posted it, and record the action. Removal under this policy does not preclude separate enforcement under our Community Guidelines.
Counter-notices
If your content was removed and you believe the removal was a mistake or misidentification, you may send our agent a counter-notice containing:
- Your physical or electronic signature.
- Identification of the removed material and where it appeared before removal.
- A statement under penalty of perjury that you have a good-faith belief the material was removed by mistake or misidentification.
- Your name, address, and telephone number, and a statement that you consent to the jurisdiction of the federal district court for your district (or, if outside the United States, for the federal district where Granary may be found), and that you will accept service of process from the original complainant.
On receiving a compliant counter-notice, we will forward it to the original complainant and restore the material within 10 to 14 business days, unless the complainant notifies us within that window that they have filed a court action against you. Filing a false counter-notice exposes you to liability under 17 U.S.C. 512(f).
Repeat-infringer policy
We terminate the accounts of users who are repeat infringers, in appropriate circumstances, as required by 17 U.S.C. 512(i). Our standard: three valid, uncontested infringement removals against an account result in permanent termination. We may terminate sooner for egregious infringement. Terminated users may not create new accounts.
In-app reporting
You can also report suspected infringement from inside the app using the report flow on any post, comment, message, or room. In-app reports that state a copyright claim are processed under this policy. An in-app report is not a DMCA notice unless it contains every element listed above; sending it to the designated agent by email is the reliable path.
EU users
Reports of illegal content from users in the European Union are also handled under our notice-and-action practices. Where EU law requires a different procedure for a given report, the stricter applicable procedure controls.
Changes
We may update this policy at any time; material changes are announced as described in our Terms of Service. Contact: granary.usa@gmail.com.
