End-User License Agreement
Effective date: The date this agreement is first published at gukkit.com/legal.
This End-User License Agreement ("EULA") is between you and Granary ("Granary," "we," "us") and governs your use of the Gukkit mobile application (the "App"). By installing or using the App, you agree to this EULA and to the Gukkit Terms of Service, which are incorporated by reference. If you do not agree, do not install or use the App.
1. License grant
We grant you a personal, non-exclusive, non-transferable, revocable, limited license to install and use the App on devices you own or control, solely for your personal, non-commercial use in connection with the Gukkit service and in compliance with this EULA and the Terms of Service.
2. Restrictions
You may not, except as permitted by applicable law:
- Copy, modify, adapt, translate, or create derivative works of the App.
- Reverse engineer, decompile, or disassemble the App, or attempt to derive its source code.
- Rent, lease, lend, sell, sublicense, or redistribute the App.
- Remove or alter any proprietary notices in the App.
- Use the App to violate any law or the Gukkit Terms of Service or Community Guidelines.
- Circumvent any technical limitations or security features of the App.
3. Updates
We may provide updates to the App that add, modify, or remove features. Updates may install automatically depending on your device settings. Continued use after an update constitutes acceptance of the updated App. Some updates may be required for the App to keep working with the Service, and older versions may stop working.
4. Third-party services and stores
The App is distributed through third-party app stores. Those stores are not parties to this EULA and are not responsible for the App or the Service, except for any minimum terms the store's own policies impose. If the App integrates a third-party service, your use of that service within the App is subject to that service's terms and privacy policy in addition to ours.
5. Data and privacy
The App collects and handles data as described in the Gukkit Privacy Policy. By using the App, you acknowledge that handling.
6. Termination
This EULA is effective until terminated. It terminates automatically if you violate it. We may terminate it at any time as described in the Terms of Service. On termination, you must delete all copies of the App from your devices. Sections 7 and 8 survive termination.
7. Disclaimer of warranties
THE APP IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE APP WILL OPERATE WITHOUT INTERRUPTION OR BE ERROR-FREE.
8. Limitation of liability
TO THE FULLEST EXTENT PERMITTED BY LAW, WE WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES ARISING FROM THE APP. OUR TOTAL LIABILITY UNDER THIS EULA WILL NOT EXCEED THE GREATER OF THE AMOUNTS YOU PAID US IN THE 12 MONTHS BEFORE THE CLAIM AROSE OR ONE HUNDRED U.S. DOLLARS (US $100), consistent with Section 16 of the Terms of Service.
9. Export compliance
You may not use or export the App in violation of U.S. export laws and regulations. You represent that you are not in a country subject to a U.S. government embargo and are not on any U.S. government list of prohibited parties.
10. Governing law and disputes
This EULA is governed by the laws of the State of Nevada, and disputes are resolved as described in Section 18 of the Terms of Service (informal resolution, then binding individual arbitration with class and jury waiver, to the extent permitted by law).
11. General
If any provision of this EULA is held unenforceable, the rest remains in force. This EULA and the Terms of Service are the entire agreement regarding the App. Contact: granary.usa@gmail.com.
